CONTRACT FOR PRACTITIONERS
CONFIRMING BOOKINGS
Nugent Education will provide all details and requirements before commencement of any session or programme. We will provide addresses, times and contact numbers (where necessary). If you require any further information then please contact us using the details provided at the front of this document. We will make all relevant liaisons with clients before sessions commence and during the delivery of a programme, except where otherwise requested and artists can obtain information through us.
WORKSHOP CONTENT AND DELIVERY
We will provide as much detail regarding topics, themes or outcomes. As a freelance artist the final planning and content / style of delivery of the sessions is your responsibility. We insist that artists always start all workshop sessions by introducing themselves as being provided by Nugent Education, and not use workshops we send you to as a platform to promote their own company.For example, all sessions should begin with introducing yourself, and as been sent from Nugent Education Limited.
Artists must make sure that they arrive at least 15 minutes early to set up. Also, please make sure that you are contactable (phone on) for at least the 24 hour period before any workshop. If there are any last minute changes or cancellations made by the client and the artist is not contactable, we cannot be responsible and will not pay any cancellation fee.
If you are to be late then Nugent Education should be informed at least 24hours before hand. We reserve the right to cancel sessions that and provide other alternatives to the session if the artist is too late for the session to be worthwhile, or late without informing us; in such a case the artist will no longer be eligible for payment for that session.
If a client wants to book artists for other work or make any further enquiries during or after a workshop, the artist must refer them back to us. Therefore, always ensure that you have Nugent Education’s contact details and / or promotional leaflets available.
We have observed, on a number of occasions, artists giving their personal details to clients in the hope of securing more work for themselves. A client may see this as a way of getting more of the same workshops in the future and paying less, as freelancers usually charge less than a company such as us. However, we must charge more to cover our overheads. The amount of work that we do is a reflection of years of work and financial investment into marketing and advertising. We cannot allow for someone that we send to a job to then undermine these efforts and investments by undercutting us with contacts that we have made. For this reason we have introduced a policy whereby any artist found to be attempting to poach a client, as described above, will be struck from our books with immediate effect, and replaced with another artist.
Note: this is the same for all companies that out-source other people’s skills, in any given industry.
REGISTERS / TIME SHEETS AND EVALUATION FORMS
We will provide you with registers / time sheets and feedback forms, which you can photocopy or print off (online at our website). We will expect to receive registers with times of arrival and completion of workshop, signed by the client, and sent along with invoices. We reserve the right to withhold payment of any invoices until these are returned and fully completed. We also urge you to get the client and / or participants to fill in feedback forms, where possible, and return these also, with you other paperwork. These help us to assess how well you are doing, and provide examples of feedback for your work to future clients that may be interested in booking the workshop that you deliver. We always call artists back after sessions to ascertain these details as well as receiving the feedback forms.
PROBLEMS
If we have to cancel or rearrange a session it can be detrimental to our goodwill, and it puts us to expense and inconvenience. If an artist is recurrently unreliable then we will seek to offer an alternative artist.
If you do have to cancel a booking, or are running late, please phone Ash immediately on: 0781 327 0232. Alternatively use any of the other numbers provided to let someone at Nugent Education know. If necessary you may leave a message or send a text, and keep us informed of your progress until arrival. We will liaise with the client, or instruct you to call them.
There have been times when artists have took it upon themselves to voice personal disputes with clients without us knowing, and this has lead to contracts been lost.As well as not giving out telephone numbers or other personal details to clients, we want any disagreements or issues to be outlined to us in the first instance, not the client without us knowing.We will be unable to work with practitioners who choose to ignore these requirements.To sum up, if they have been any complications or concerns raised by the client during a workshop please contact us ASAP with the details. This can help to protect the good name of Nugent Education and considerably improve subsequent dealings with the client.
INVOICES
Nugent Education does not enter into a formal contract with artists. You are self employed and will subcontract to us on a self-employed basis. We will require an invoice from you at or just after the end of each month that you deliver workshops on our behalf. We will provide a generic invoice that artists can fill in by hand or electronically and return to us at the postal address or email addresses provided. If you do not wish to use our generic invoice then please make sure that your invoice details the following:

You must state that you are responsible for you own tax and NI contributions, and quote you schedule D number if you have one.
PAYMENT & FEES
We pay invoices at the end of every month for all work completed the month previous. For example: if you do a workshop on the 15TH March, we would pay at the end of April, providing all paper work and invoices have been received.
For payments and levels of pay to increase, artists must:
1: Send us your completed CV with 2 referees
2; attend our induction and adhere to the guidelines in this contract and sign it
3: successfully pass two observations
4: show that you can work well autonomously and receive good feedback from clients
We have recently introduced a scale of payments that are outlined below.
Nugent Education reserves the right to re-evaluate individual pay scales at any time!
Lateness
We cannot ask a client to pay for work that hasn’t been delivered.
If you arrive late then we may have to offer the client a reduction. Therefore we have a policy of deducting for time not delivered. We will deduct £10 for every 10 minutes of workshop that has not been delivered as agreed.
EQUIPMENT & MATERIALS
As a freelance practitioner you are expected to provide all of your own equipment and materials for the workshops. If there are particular materials that need to be purchased we will agree a materials budget with you beforehand. Please add these costs to your invoice. These will be paid along with the invoices, only when we receive all genuine receipts (not hand written). With no receipts we will not be able to pay for materials. All materials left over after the workshop should be returned to Nugent Education at our St Helens Office.
We do have a store of materials and may be able to provide you with what is needed. If you wish to use any of our electrical equipment you will be expected to pay a smalldaily hire fee of £20 per day. This is used to avoid artists keeping hold of our equipment for undue lengths of time (as this has occurred in the past) and to prompt the artist to buy their own equipment. Hire charges can be paid on the spot or deducted from end of month payments. Please remember to note such deductions on your invoice. All materials and equipment taken from the company must be signed for when picked up and dropped off.
INSURANCE
We advise that artists have their own Public Liability Insurance. Nugent Education Ltd has an insurance policy with cover for up to 5 million pounds. However, if an accident did occur that was clearly not the fault of the company, the injured party may choose to chase the artist for damages. Also, if our insurance company did pay out for damages, they may then use something called subrogation rights. In short, this means that they would seek to sue the artist by proving liability to get back the money that they have paid out.
OUR COMMITMENT
Nugent Education is committed toproviding well paid work for artists and practitioners. We are a commercial organisation and profits are heavily reinvested into the company to improve on the service that we provide. We regularly invest in marketing and advertising mediums, and send information direct to schools and other potential clients on a regular basis. People sometimes comment that our charges are not cheap. However, we charge a good price, so that we can pay you well and keep improving the company.
Please help us to help you be a part of our success. You can do this by observing the guidelines outlined in this document, showing loyalty to us, helping to promote our company by giving out our leaflets and paying lip service to the company, and giving us as much feedback and advice as possible. We realise that there is always room for improvement.
POLICIES
All artists will be provided with a copy of our Health and Safety Policy, Child Protection and Safeguarding Children Policies, and are expected to read them in full before starting delivery of any workshops. The policies are also available to view or download on our website.

Delivery, Care & Reflection
I will always act with respect and use good manners when dealing with Nugent Education’s clients and workshop participants and remain friendly and approachable
I will, where possible, provide my own materials and equipment for my sessions
I will always be clear about the support I require from Nugent Education and their clients to ensure successful delivery
I will always endeavour to receive feedback forms from clients and practitioners, and to return these to Nugent Education ASAP
I will contact Nugent Education after a workshop has taken place (email or text will suffice in the first instance) to let them know how it has gone
I will return any unused materials to Nugent Education head office, and keep all receipts for purchases made
I will reflect on my work, and take note of any problems to ensure improved future performance
